COURSE TERMS AND CONDITIONS

These Course Terms and Conditions ("Course Terms") apply to educational courses, learning programmes, and digital learning materials ("Courses") offered through the digital platform operated by DEATH DOULA LTD, a private limited company incorporated in England and Wales (Company Number 17171845), with its registered office at 54 Mead Way, High Wycombe, England, HP11 1RH ("Company", "we", "us", or "our").
These Course Terms supplement our Terms of Service and Refund Policy. If there is a conflict concerning the purchase of, access to, or use of a Course, these Course Terms apply to that matter. Professional qualification, Active Specialist Status, Admission to Practice, and professional-regulation matters administered by an affiliated non-profit organisation are governed by that organisation's own normative documents.
Please read these Course Terms before purchasing or enrolling in a Course. By purchasing, enrolling in, or accessing a Course in circumstances where these Course Terms are presented to you, you agree to them.
1. NATURE OF THE COURSES
1.1.
Courses offered through the Platform provide education and training relating to non-medical end-of-life support, grief literacy, professional development, and other subjects described on the relevant Course page.
1.2. Educational purpose and professional boundaries
Unless expressly stated otherwise for a particular programme, Courses are educational in nature. Course content does not constitute medical, nursing, psychiatric, psychological, psychotherapeutic, legal, or financial advice and does not replace consultation with appropriately qualified professionals.
Completing a Course does not authorise a person to provide medical, therapeutic, legal, or other regulated professional services for which a separate licence, registration, qualification, or legal authority is required.
1.3. Emotionally sensitive content
Some Courses address death, dying, grief, loss, illness, trauma, suicide bereavement, or other emotionally difficult subjects. You are responsible for considering your readiness to engage with such material. If you are in acute distress or require clinical, crisis, or emergency support, seek assistance from an appropriate professional or the emergency or crisis services available in your country or region.
2. ENROLMENT AND ACCESS
2.1.
A Course may be free, paid, invitation-only, or subject to an application or approval process. The applicable access conditions are stated on the relevant Course page or during enrolment.
2.2.
For paid Courses, access is normally granted to your personal account after successful payment is confirmed. For application-based or approval-based Courses, access may also depend on satisfaction of the stated admission requirements and approval of the application.
2.3.
Unless a different access period is stated on the Course page or at checkout, access to purchased Course content is provided for 12 months from the date of purchase. The access period presented to you at the time of purchase forms part of your contract.
2.4. Personal access
Course access is personal to the enrolled user. You must not share your account or paid access, resell access, or make Course content available to non-enrolled persons except where the Course expressly permits group or organisational use.
A material breach of this requirement may result in suspension of access, subject to applicable consumer law and the Refund Policy.
2.5. Technical delivery
Courses are delivered through the Platform and may include text, video, audio, images, downloadable materials, quizzes, assessments, live or recorded sessions, or other learning formats as specified for the particular Course.
3. COURSE CONTENT, UPDATES, AND CHANGES
3.1.
We may correct, update, improve, or restructure Course content to maintain accuracy, quality, accessibility, or relevance. This may include changes to modules, lessons, examples, assessments, resources, or technical presentation.
3.2.
The Course description, access period, price, material features, and any stated qualification or certificate outcome presented at the time of purchase determine what you are entitled to receive.
3.3.
We will not make a material reduction to the substance of a paid Course already purchased without providing an appropriate remedy where required by the Refund Policy or applicable consumer law.
3.4.
Minor editorial corrections, factual updates, accessibility improvements, changes required by law or professional standards, and technical changes that do not materially reduce the substance of a Course do not constitute a failure to supply the Course as described.
4. ASSESSMENTS, EDUCATIONAL RECORDS, AND PROFESSIONAL QUALIFICATION
4.1. Assessments
Some Courses include quizzes, examinations, assignments, practical tasks, interviews, or other assessments. Where an assessment must be passed to complete a Course, receive an educational document, progress to another stage, or satisfy a professional-education requirement, this will be stated in the Course information or the applicable educational rules.
4.2. Certificates of completion and other Course records
Some Courses may provide a certificate of completion, statement of participation, or other educational record. The issuer and meaning of the document are determined by the relevant Course.
A general certificate of completion confirms only the educational outcome stated on that certificate. It is not a state-accredited diploma, academic degree, licence to practise a regulated profession, or evidence of Active Specialist Status unless the document expressly states otherwise and is issued under the applicable professional-regulation system.
4.3. Professional education administered by an affiliated organisation
Certain Courses or programmes may form part of the professional education system of the Ukrainian public organisation Громадська організація «Доула Смерті» (registration number 46392077), which is legally separate from DEATH DOULA LTD ("Affiliated Organisation").
Where the Affiliated Organisation designates a programme as a professional education programme, successful completion of the applicable educational stage and required assessment may result in an Education Certificate issued under the Affiliated Organisation's Educational Standard.
An Education Certificate confirms completion of the relevant professional education stage and acquisition of the corresponding qualification. It does not, by itself, confer a current right to practise under the auspices of the Affiliated Organisation.
4.4. Active Specialist Status and Admission to Practice
The current right to practise under the auspices of the Affiliated Organisation is governed separately through Active Specialist Status (Admission to Practice) and, where applicable, inclusion in the Register of Active Specialists.
Active Specialist Status is separate from an Education Certificate and may be subject to requirements such as a declaration or professional agreement, supervision, professional liability insurance, first-aid training for relevant qualification levels, acceptance of current professional rules, and other requirements established by the Affiliated Organisation.
4.5. No purchase of professional status
Payment for a Course does not purchase or guarantee:
- successful completion of the Course;
- passing an assessment;
- an Education Certificate;
- a particular qualification;
- Active Specialist Status or Admission to Practice;
- inclusion or continued inclusion in the Register of Active Specialists.
Each outcome depends on the applicable educational or professional requirements.
4.6. Separate legal responsibilities
DEATH DOULA LTD operates the digital Platform, sells or administers access to Courses where it is the relevant trader, processes or facilitates payment through payment providers, and provides related technical services.
The Affiliated Organisation independently determines its professional education requirements, qualifications, Education Certificates, Active Specialist Status, Admission to Practice, registry rules, professional standards, supervision requirements, and professional disciplinary matters under its own documents.
Where the Platform technically generates, displays, stores, or delivers an educational or professional document on behalf of the Affiliated Organisation, this technical function does not transfer the Affiliated Organisation's professional decision-making authority to DEATH DOULA LTD.
5. INTELLECTUAL PROPERTY AND PERMITTED USE
5.1.
Course materials, including texts, videos, audio, presentations, illustrations, workbooks, quizzes, assessments, and design elements, are protected by intellectual property law. Rights may belong to DEATH DOULA LTD, the Affiliated Organisation, individual authors, or other licensors, as identified or applicable.
5.2.
Unless the relevant Course states otherwise, you receive a personal, non-exclusive, non-transferable licence to use Course materials for your own learning during the applicable access period.
You must not, without permission or another lawful basis:
- reproduce or distribute substantial parts of Course materials;
- resell or commercially exploit Course materials;
- publish or make paid Course materials publicly available;
- record protected live or recorded Course content where recording is not permitted;
- remove copyright, attribution, or proprietary notices;
- share paid access or account credentials with another person.
5.3.
Where a download function is expressly provided, you may download the relevant material for the personal use permitted by the Course.
5.4.
Nothing in these Course Terms prevents you from applying general knowledge, skills, methods, or learning lawfully acquired through a Course, subject to applicable professional rules and intellectual property law.
You must not represent yourself as holding a qualification, Education Certificate, Active Specialist Status, professional registration, or other credential that you have not actually been granted.
6. STUDENT CONDUCT
6.1.
Where a Course includes comments, live sessions, group activities, community spaces, peer interaction, or other interactive features, you must:
- communicate respectfully;
- protect the confidentiality of personal stories shared by other participants;
- refrain from harassment, threats, unlawful discrimination, or abusive conduct;
- refrain from recording sessions where recording is not expressly permitted;
- respect the professional and educational boundaries of instructors, facilitators, and other participants;
- refrain from unauthorised commercial solicitation of participants.
6.2.
Serious or repeated misconduct may result in restriction or removal from interactive features or, where reasonably necessary, suspension or termination of Course access. Any action affecting paid access will be subject to the Refund Policy, applicable consumer law, and the circumstances of the breach.
7. PAYMENT, CANCELLATION, AND REFUNDS
7.1.
Course prices, currencies, and available payment methods are shown on the relevant Course page or at checkout. Payments are processed through the payment providers identified before you complete the transaction.
7.2.
Cancellation, cooling-off, and refund rights are governed by our Refund Policy and applicable consumer law.
7.3. Digital content supplied during the cancellation period
Where a Course includes digital content supplied immediately, we may ask you before access begins to:
- expressly consent to supply of the digital content beginning before the end of the statutory cancellation period; and
- acknowledge that, once supply begins, you may lose the statutory right to cancel that digital content where applicable law permits this.
The legal effect of that consent depends on the nature of the Course, the content or service supplied, and the consumer law applicable to the transaction. Our Refund Policy explains the applicable process in more detail.
7.4.
Nothing in these Course Terms limits rights or remedies that cannot lawfully be excluded, including statutory remedies for digital content or services that are faulty, not of satisfactory quality, not fit for an applicable purpose, or not as described.
8. TECHNICAL REQUIREMENTS AND SUPPORT
8.1.
You are responsible for having a reasonably current device, browser, internet connection, and any other basic technology necessary to access the Platform, unless different technical requirements are stated for a particular Course.
8.2.
We provide reasonable technical support for Platform-side access problems through [email protected].
8.3.
We are not responsible for access problems caused solely by your device, internet provider, local network, browser configuration, or third-party software, but this does not limit any responsibility we have for faults in the Platform or digital content itself.
9. COURSE AVAILABILITY AND DISCONTINUATION
9.1.
We may stop offering a Course to new learners at any time.
9.2.
If a paid Course you already purchased is withdrawn or becomes unavailable during your agreed access period, we will use reasonable measures to preserve access, provide an appropriate replacement where acceptable, or provide another remedy required by the Refund Policy or applicable consumer law.
10. LIABILITY
10.1.
The liability provisions in our Terms of Service apply to Courses.
10.2.
Educational content is intended to support learning and professional development. We are not responsible for decisions made independently by a learner in personal or professional practice merely because the learner has studied Course content, except to the extent that liability arises from our breach of contract, negligence, breach of statutory duty, or another matter for which liability cannot lawfully be excluded.
10.3.
Nothing in these Course Terms excludes or limits your statutory rights concerning the quality, description, or supply of digital content or services.
11. RELATIONSHIP WITH THE AFFILIATED ORGANISATION'S PROFESSIONAL DOCUMENTS
11.1.
Where a Course forms part of the Affiliated Organisation's professional education system, educational and professional matters are also governed by the applicable version of that organisation's Charter, Ethical Code, Educational Standard, Professional Practice Standards, declarations, policies, regulations, and other mandatory professional documents.
11.2.
These Course Terms govern the commercial and Platform relationship with DEATH DOULA LTD. The Affiliated Organisation's professional documents govern professional qualification, Active Specialist Status, Admission to Practice, registry participation, supervision, professional standards, and disciplinary matters.
11.3.
If there is an apparent conflict between these Course Terms and a professional document of the Affiliated Organisation, each document applies within the legal and operational sphere of the entity that issued it. These Course Terms do not override the Affiliated Organisation's professional-regulation decisions, and the Affiliated Organisation's professional documents do not alter statutory consumer rights arising from a purchase from DEATH DOULA LTD.
12. GOVERNING LAW AND CONSUMER RIGHTS
12.1.
These Course Terms are governed by the laws of England and Wales.
12.2.
If you are a consumer resident in another country, you retain the benefit of any mandatory consumer protection provisions of your country of residence that apply regardless of this choice of law.
12.3.
Nothing in these Course Terms is intended to exclude or restrict rights that cannot lawfully be excluded or restricted.
13. CHANGES TO THESE COURSE TERMS
13.1.
We may update these Course Terms to reflect changes in law, Course delivery, Platform functionality, professional arrangements, or our business operations. The current version will be published on the Platform with its "Last Updated" date.
13.2.
We will not use this section as a general right to impose a material reduction in a paid Course or an unexpected material disadvantage after purchase. Changes will not retrospectively remove statutory rights or remedies relating to a purchase already made.
Where a material change affects an ongoing paid Course, we will give reasonable notice where required and reasonably practicable and will provide any cancellation right, continuation option, replacement, price reduction, refund, or other remedy required by applicable consumer law.
